Terms of Carriage

Effective April 1, 2026

1. Definitions

"Carrier" means Palvoryn Air Holdings, Inc. d/b/a Palvoryn Airlines and its subsidiaries. "Passenger" means any person holding a valid ticket for transportation on any Palvoryn flight. "Ticket" means the electronic document or itinerary receipt issued by or on behalf of Carrier. "Tariff" means the fares, rules, and conditions filed with the U.S. Department of Transportation.

2. Applicability

These Conditions of Carriage apply to all transportation of passengers and baggage performed by Palvoryn Airlines. By purchasing a ticket, the passenger agrees to these conditions. In the event of conflict between these conditions and any applicable tariff, the tariff shall prevail.

3. Ticketing

Tickets are non-transferable. The named passenger must present valid government-issued photo identification matching the name on the ticket. Tickets are valid for one year from the date of issue. Fare rules govern refundability, change permissions, and routing restrictions.

4. Fares and Taxes

All fares are quoted in US dollars and include applicable taxes and government-imposed fees unless otherwise stated. Fares are subject to change without notice until ticketed. Promotional fares may have additional restrictions including advance purchase, minimum/maximum stay, and capacity limitations.

5. Baggage

Carrier's liability for loss, damage, or delay of checked baggage is limited to $3,800 per passenger for domestic travel (per 14 CFR 254) and approximately $1,780 (1,288 SDRs) for international travel (per the Montreal Convention). Carrier is not liable for fragile, perishable, or improperly packed items. Declared value coverage may be purchased at check-in.

6. Denied Boarding

In the event of an oversold flight, Carrier will first seek volunteers willing to relinquish their seats in exchange for compensation. If insufficient volunteers are obtained, passengers may be denied boarding involuntarily in accordance with Carrier's priority rules. Involuntarily denied passengers are entitled to compensation as required by 14 CFR 250.

7. Delays and Cancellations

Carrier will use commercially reasonable efforts to transport passengers on schedule, but schedules are not guaranteed. In the event of a delay or cancellation within Carrier's control, Carrier will offer rebooking on the next available Palvoryn flight at no additional cost, or a full refund. Meal vouchers and hotel accommodations are provided for overnight delays caused by Carrier.

8. Passenger Conduct

Passengers must comply with all instructions of the flight crew. Carrier reserves the right to refuse transport or remove any passenger whose conduct is disorderly, abusive, or poses a safety risk. Smoking, including electronic cigarettes, is prohibited on all Palvoryn flights.

9. Governing Law

For domestic transportation, these Conditions are governed by the laws of the State of Colorado and applicable federal law. For international transportation, the Montreal Convention or Warsaw Convention applies. Any disputes shall be subject to the exclusive jurisdiction of the courts of Denver, Colorado, unless preempted by federal law or international treaty.
